OLD LYME ZONING COMMISSION
PUBLIC HEARING
Monday, April 14, 2014

The Old Lyme Zoning Commission held a Public Hearing on Monday, April 14, 2014, at 7:30 p.m. in the Auditorium of Memorial Town Hall.  Those present were Jane Cable, Chairman, John Johnson, Vice Chairman, Jane Marsh, Secretary, J. Bozek, regular member and Ted Kiritsis, alternate.

Also present was Ann Brown, Zoning Enforcement Officer.

Chairman Cable called the Public Hearing to order at 7:32 p.m.

1.      Special Permit Application and Municipal Coastal Site Plan Review Application to permit dock renovations in accordance with Section 4.3.2.a of the Zoning Regulations on property located at 23 Ferry Road, Robin Sedgwick, applicant/property owner.

Ms. Marsh read the legal notice as published in The Day on Tuesday, April 1 and Tuesday, April 8, 2014.  She then read the Exhibit List for the record.

Keith Neilson, Docko, was present to explain the application.  He submitted the mailing receipts.  Mr. Neilson noted that they have received the DEP and Army Corps permits.  He explained that the part that is on shore is the part that comes under the Zoning Commission’s jurisdiction.  

Mr. Neilson explained the application.  He explained that there is a small section of pier that comes ashore.  Mr. Neilson stated that the DEP and Army Corps permits show that there were several other issues that were resolved during the permitting process.  He noted that any impacts on neighbors or coastal resources have all been addressed.  Mr. Neilson noted that the coastal site plan is complete.

Mr. Neilson explained that there will be electricity on the dock for recharging the boat batteries, as well as water at the dock.  He pointed out the lighting on the dock and noted that it is not on a timer, rather there is an on and off switch.

Mr. Johnson questioned the size of the floating dock.  Mr. Neilson replied that the floating dock is 6’ x 16’.  Mr. Kiritsis questioned whether the lighting would be directed down.  Mr. Neilson explained that the lighting, which he has been using for about a year and a half now, directs the light down.  Ms. Bozek stated that the Commission’s review is limited and questioned whether the Commission had any say over the lights on the dock.  Ms. Brown explained that the water service and electrical on the dock crosses through the portion of the project that is the Commission’s review area, so they do have a say.  Ms. Bozek stated she remembers in the past they have asked to have the lighting shown on the plan.  Ms. Brown explained that the Commission has done that in cases where the walkways are lit or the portion of the structure that is under their review.  Mr. Neilson noted that the lighting is shown on the plans.

No one present spoke in favor of or against the application.  Hearing no further comments Chairman Cable asked for a motion to close the Public Hearing.

A motion was made by John Johnson, seconded by Ted Kiritsis and voted unanimously to close the Public Hearing on the Special Permit Application and Municipal Coastal Site Plan Review Application to permit dock renovations on property located at 23 Ferry Road, Robin Sedgwick, applicant/property owner.

Chairman Cable adjourned the Public Hearing at 7:50 p.m.
